These Terms of Use govern your access to and use of the services, platform, and content provided by Tybugyo through tybugyo.com. By accessing or using the platform, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must not use the platform.
1. Definitions
For the purposes of these Terms, the following definitions apply:
- Platform refers to the website, tools, learning materials, and services accessible at tybugyo.com.
- User refers to any individual who accesses or interacts with the Platform.
- Account refers to a registered profile created by a User to access personalised features of the Platform.
- Content refers to all text, video, audio, exercises, assignments, and other materials made available through the Platform.
- Services refers to the educational workshops, programmes, and interactive tools offered by Tybugyo.
2. Eligibility
You must be at least 18 years of age to create an Account and use the Platform independently. If you are under 18, you may only use the Platform with the direct involvement and consent of a parent or legal guardian. By using the Platform, you represent and warrant that you meet these eligibility requirements.
3. Account Registration
3.1 Creating an Account
Certain features of the Platform require you to register for an Account. When registering, you agree to provide accurate, current, and complete information. You are responsible for keeping your Account credentials confidential and for all activity that occurs under your Account.
3.2 Account Security
You must notify Tybugyo immediately at help@tybugyo.com if you become aware of any unauthorised use of your Account or any other breach of security. Tybugyo will not be liable for any loss or damage arising from your failure to maintain the confidentiality of your credentials.
3.3 Account Termination by User
You may close your Account at any time by contacting us at help@tybugyo.com. Upon closure, your access to personalised content and Services will cease.
4. Permitted Use
The Platform is made available for lawful, personal, and non-commercial educational purposes only. You agree to use the Platform solely in a manner consistent with these Terms and applicable law.
You must not:
- Use the Platform for any unlawful, fraudulent, or harmful purpose.
- Reproduce, distribute, or publicly display any Content without prior written authorisation from Tybugyo.
- Attempt to gain unauthorised access to any part of the Platform or its underlying systems.
- Interfere with or disrupt the integrity or performance of the Platform.
- Use automated tools, bots, scrapers, or crawlers to extract data from the Platform.
- Impersonate any person or entity or misrepresent your affiliation with any person or entity.
- Upload or transmit content that is defamatory, obscene, threatening, or otherwise objectionable.
- Circumvent any access controls, digital rights management mechanisms, or security measures.
5. Intellectual Property
5.1 Ownership
All Content, design elements, trademarks, logos, and materials available on the Platform are the exclusive property of Tybugyo or its licensors and are protected by applicable intellectual property laws. Nothing in these Terms transfers any ownership rights to you.
5.2 Limited Licence
Subject to your compliance with these Terms, Tybugyo grants you a limited, non-exclusive, non-transferable, revocable licence to access and use the Platform and its Content solely for your personal educational purposes.
5.3 User-Submitted Content
If you submit, upload, or share any content through the Platform, including assignments, comments, or feedback, you grant Tybugyo a non-exclusive, worldwide, royalty-free licence to use, store, display, and reproduce that content solely for the purpose of operating and improving the Platform. You retain ownership of your submitted content.
6. Payments and Enrolment
6.1 Fees
Access to certain workshops or programmes may require payment of fees as indicated on the Platform at the time of enrolment. All fees are stated inclusive of applicable taxes unless otherwise specified.
6.2 Payment Processing
Payments are processed through third-party payment providers. Tybugyo does not store your full payment card details. By providing payment information, you authorise the applicable charges.
6.3 Refunds
Refund eligibility is determined by the specific programme or workshop terms communicated at the point of purchase. Where no specific terms are stated, requests for refunds submitted within 14 days of purchase and before substantial programme content has been accessed will be considered on a case-by-case basis. 7. Third-Party Links and Services
The Platform may contain links to third-party websites, tools, or services. These links are provided for convenience only. Tybugyo does not endorse, control, or accept responsibility for the content, privacy practices, or availability of any third-party resources. Your use of third-party services is at your own risk and subject to their respective terms.
8. Disclaimer of Warranties
The Platform and all Services are provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied. Tybugyo does not warrant that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components. To the fullest extent permitted by law, Tybugyo disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Educational outcomes are not guaranteed. Results depend on individual effort, engagement, and circumstances beyond the control of Tybugyo.
9. Limitation of Liability
To the maximum extent permitted by applicable law, Tybugyo and its officers, employees, agents, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of or inability to use the Platform or Services, even if advised of the possibility of such damages.
In no event shall Tybugyo's total liability to you for all claims arising from or related to these Terms or the Platform exceed the total amount paid by you to Tybugyo in the twelve months preceding the event giving rise to the claim, or €100, whichever is greater.
10. Indemnification
You agree to indemnify, defend, and hold harmless Tybugyo and its officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or related to your use of the Platform, your violation of these Terms, or your infringement of any rights of a third party.
11. Privacy
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Platform, you consent to the collection and use of your information as described in the Privacy Policy.
12. Modifications to the Platform and Terms
12.1 Changes to the Platform
Tybugyo reserves the right to modify, suspend, or discontinue any part of the Platform or Services at any time, with or without notice. Tybugyo shall not be liable to you or any third party for any such modification, suspension, or discontinuation.
12.2 Changes to These Terms
Tybugyo may update these Terms from time to time. When changes are made, the "Last updated" date at the top of this page will be revised. If changes are material, we will make reasonable efforts to notify registered users. Your continued use of the Platform following any update constitutes your acceptance of the revised Terms.
13. Suspension and Termination
Tybugyo reserves the right to suspend or terminate your access to the Platform at any time, with or without notice, if you breach these Terms or engage in conduct that Tybugyo determines, in its sole discretion, to be harmful to other users, third parties, or the integrity of the Platform. Upon termination, your licence to use the Platform ceases immediately.
14. Governing Law and Disputes
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Tybugyo operates. Any disputes arising from or related to these Terms or your use of the Platform shall first be subject to good-faith negotiation. If a dispute cannot be resolved informally, it shall be submitted to the competent courts of the applicable jurisdiction.
15. Severability
If any provision of these Terms is found to be invalid, unlawful, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the validity or enforceability of the remaining provisions.
16. Entire Agreement
These Terms, together with the Privacy Policy and any other policies referenced herein, constitute the entire agreement between you and Tybugyo regarding your use of the Platform and supersede all prior agreements, representations, or understandings relating to the same subject matter.
